PROJECT
The international system of legal protection for foreign investment has in recent years experienced major transformations: both of a substantive nature, such as new trade agreements and their overlapping with prior international, bilateral investment promotion and protection agreements (APPRI); and in the judicial sphere, with the emergence of new mechanisms for settling disputes, such as the possibility of creating a permanent international court. In this project, Pascual aims to determine the judicial problems raised by these reforms and what role the EU will play in this matter, given that in 2009 responsibility for the protection of foreign direct investment was transferred from the Member States to the EU.
